Terms of Service
The following Terms of Service apply to the access and use of all the contents and services contained by the web sites developed by Emporio Ferial, S.A. (referred to herein as Emporio Ferial), located at http://www.emporioferial.com and http://www.iberwine.es (referred to herein as Web Site).
You acknowledge that, by using or accessing the Web Site, you become a customer, and express your complete agreement to abide by each of the terms set forth below.
Services provided by the Web Site
Emporio Ferial reserves the right to make improvements and/ or changes in the Web Site contents and presentation, as well as in the services provided and its requisites, at any time without notice and without liability to the customer of any kind.
Customer Obligations
The customer agrees to carefully use the Web Site, and the services offered in connection therewith, respecting the Law, the moral statements and the public order, and also following these Terms of Use in its general provisions and the particular ones that could apply to each case. The customer shall not use the Web Site and its services in a way to damage, affect or interfere in its regular functioning and the services provided to other customers, and shall not damage or affect Emporio Ferial goods and rights, its suppliers, customers or third part of any kind.
When using the Web Site and the services offered in connection, the customer specifically agrees (in addition to the obligations expressed before) not to do any of the following:
Add, save or disseminate through the Web Site or through any of its services software, information, virus, code of any kind, as well as other electronic device capable of damaging any equipment, system or net from Emporio Ferial, its customers and suppliers, or third parties of any kind, neither interfere on its regular functioning.
Destroy, change, ruin or damage the data, information, software and electronic documents of Emporio Ferial, its suppliers and third parties.
Use the contents, specially the information contained in the Web Site to send neither advertisement nor commercial messages, neither collect and store personal information from third parties.
The customer shall be responsible for the harms and damages of all kinds that Emporio Ferial and its affiliates may suffer directly or indirectly, caused by the violation of these Terms of Service while using the Web Site and its services. Likewise, the customer will release Emporio Ferial from any penalty, claim or prosecution determined by a third party, including public organizations, against Emporio Ferial, its affiliates, employees and agents, caused by the infringement of the rights of third parties by the customer that fails to obey these Terms of Service while using the Web Site and its services.
Intellectual and Industrial Property
The customer acknowledges that all contents (the structure, selection, presentation and software used) on the Web Site and on each one of the services offered in connection are protected by the copyrights and belong to Emporio Ferial, its affiliates and third parties. Unless specifically authorized by Emporio Ferial, or third parties (if applicable), or in the cases stated by the law, the customer can not reproduce, change, modify, prepare derivative works based on, mirror, distribute, rent, borrow, post or aloud public access to any of the elements described before in any kind of public communication.
The customer shall use the materials, elements and information contained by the Web Site and its services for his needs only, without exploiting it for any commercial purposes.
The customer is not aloud to omit or delete the signs and symbols that identify the copyrights reserved to Emporio Ferial and third parties that may appear on the Web Site and on each one of the services offered through it. Beside that, the customer must not ignore or modify any technical device used by Emporio Ferial and third parties on the Web Site and its services, nor in any material, element or information contained by the Web Site to protect its own rights.
Disclaimer of warranties
Although Emporio Ferial endeavours to provide continuous access to the Web Site, as well as to the services offered through it, we cannot warrant that the operation or function of the Web Site, and any component thereof, will be uninterrupted or error free. Emporio Ferial dos not warrant the reliability of the contents and services of the Web Site to satisfy the customer personal need.
Emporio Ferial will diligently use the current ways and procedures to avoid the presence on the Web Site and on the services offered through it of viruses or other harmful elements capable of damaging the equipments used by the customer in connection to the Web Site, his data or electronic documents, but Emporio Ferial cannot warrant that the Web Site or its server is free of these elements, and cannot be responsible for the harms and damages that it may cause.
Emporio Ferial does not control nor warrant the accuracy, quality, truthfulness and reliability of the information and services announced or performed by third parties through the Web Site. Furthermore, Emporio Ferial does not control nor warrant that the contents and services announced or performed by third parties through the Web Site are free of viruses or other harmful elements.
Emporio Ferial does not warrant the availability, quality, reliability, accuracy or veracity of the contents and services contained on the web pages belonged or managed by third parties that are available on the Web Site by links. Emporio Ferial does not control the contents nor offers or sells products and services announced on those web sites, therefore Emporio Ferial shall not be liable for them.
Hyper-links
If the customer wants to include in his own web site a hyper-link that will lead to any of the Emporio Ferial Web Sites, that shall not be used in manner to create confusion among the customers about its independence from Emporio Ferial. The inclusion of a hyper-link that leads to the Emporio Ferial Web Sites does not imply that Emporio Ferial endorses its contents, and does not represent any kind of approval or partnership between the web site that contains the hyper-link and Emporio Ferial.
If the customer wishes to keep in his web site this kind of hyper-link must provide full access to other customers, respecting the presentation and information used on the Web Site at that moment. Therefore, the customers of the other web site will be able to access and see Emporio Ferial Web Site without any kind of frame, not overlapped or included in other web sites nor mixed with its contents (information, advertising or any other contents of any kind that don’t belong to Emporio Ferial and its affiliates). Thus, there are not aloud operations that prevent the customers that use the hyper-link to see the Emporio Ferial Web Site in the exactly same conditions they would do if got access directly, such as framing and others.
The customer must refrain from doing anything that can deviate the customers’ traffic from the Emporio Ferial Web Site. In particular, the customer shall refrain introducing any key word (by any manner, such as Meta tags and other, or by any way in its own matrix code) that identifies any content or product that belong to Emporio Ferial, unless this inclusion is justified by the existence of similar contents or products of his own.
The customer will not include in his own web site any content, link, advertisement or other materials of any kind that may: (1) be against the law, (2) infringement to third parties rights, (3) discredits Emporio Ferial, its products and its business rivals, (4) be considered sexual or violent, (5) promote discrimination of any kind (racial, gender, religious, age, sexual, (6) includes contents that Emporio Ferial may consider – according to its own evaluation – conflicting to its rights, image or self-interest.
